Registration

The Buyer must be in good standing and have active accounts with both NCAA and Edge Pipeline in order to gain access and bid on vehicles. By registering and using the System, the Buyer agrees to be bound by the terms and conditions set forth herein, as well as any other terms and conditions listed on run lists, announced during live auctions, and posted on the New Calhoun Auto Auction website.

Public buyers MUST ATTEND the auctions.

Public buyers cannot buy online.

Online Bidding / Suspension

The Buyer acknowledges that once the System accepts an online bid, that bid cannot be removed, but it may be reduced to the amount of the current highest bid. Please use caution when placing bids.

The Buyer acknowledges that New Calhoun Auto Auction reserves the right, in its sole discretion, to remove, disable, or suspend the Buyer’s access to the System at any time, with or without prior notice, for any reason, including but not limited to failure or delay in payment of any amounts owed to New Calhoun Auto Auction, failure to claim a vehicle, or expired registration or license.

The Buyer further acknowledges that New Calhoun Auto Auction reserves the right to modify the System or the general business practices related to it at any time, temporarily or permanently, in its sole discretion, with or without prior notice.

Online Bidding Fee

An online bidding fee of $60 will be added to the total purchase price for each vehicle, in addition to the vehicle price and auction fees. Post-Sale Inspections may be purchased for $175 on all vehicles sold with Green Light.

A Post-Sale Inspection (PSI) must be requested the same night as the sale. Post-sale inspection results are valid for 7 calendar days or 100 miles, whichever occurs first.

Payment

Payment for any awarded vehicle must be made within two (2) days, calculated as the day of the auction plus two business days. (If the auction is on Wednesday, payment is due by close of business on Friday at 1:00 p.m.)

Vehicles not paid within the stated time frame will be subject to a $100 late payment fee. Payment may be made by wire transfer, cashier’s check, cash, or credit card (additional rules apply).

Credit card payments are subject to a convenience fee. Business checks will be accepted only with prior written approval from New Calhoun Auto Auction. Any check returned to New Calhoun Auto Auction for any reason must be made good within two (2) business days. Any check returned for insufficient funds (NSF) will be subject to New Calhoun Auto Auction’s NSF processing fee. The Buyer shall be responsible for and agrees to reimburse New Calhoun Auto Auction for all collection costs associated with NSF payments, credit card chargebacks, and other past-due accounts, including but not limited to collection agency fees and/or attorney’s fees and court costs.

Vehicle Pickup

Vehicles must be removed within fourteen (14) business days.

If vehicles are not removed within the stated time frame, daily storage fees per vehicle will apply. Vehicles may be removed only during normal business hours. New Calhoun Auto Auction recommends that winning bidders remove their vehicles immediately after the sale to ensure their protection. Vehicles remaining at New Calhoun Auto Auction after the date of sale are held at the Buyer’s sole risk. The risk of loss for any purchased vehicle transfers to the Buyer once the vehicle is awarded to the Buyer.

THE BUYER SHALL INDEMNIFY, DEFEND, AND HOLD HARMLESS New Calhoun Auto Auction and the INDEMNIFIED PARTIES from and against any and all losses, claims, demands, or legal actions arising from damage to the vehicle awarded to the Buyer.

Dispute Resolution Process

If the Buyer has a dispute related to a vehicle, the following dispute resolution process shall apply: the Buyer must submit the claim in writing and address it to the General Manager of the auction where the vehicle was purchased or, if no purchase was made, where the vehicle is located. If the Buyer is not satisfied with the decision of the General Manager, the Buyer may request a review by the auction owner.

Buy Now Feature

If the Buyer chooses to purchase a vehicle using the “Buy Now” option, a $160 fee will be added to the total purchase price.

Online Arbitration

Arbitration for Green Light vehicles purchased online is seven (7) days from the date of sale. The vehicle must be returned to the auction no later than the seventh (7th) day by 5:00 p.m.

We strongly recommend obtaining a Post-Sale Inspection (PSI) on online purchases of Green Light vehicles immediately after the sale. The PSI fee is $175.00.

We will hold seller checks for Green Light vehicles sold online for seven (7) days, until the arbitration period has expired.
